occurs post loan origination when mortgage servicers use false statements and book-keeping entries, fabricated assignments, forged signatures and utter counterfeit intangible Notes to take a homeowner's property and equity.

In my foreclosure the loan servicer filed the Notice of Default without having the substitution of Trustee/Assignment of Trustee recorded so I am pushing them back to square one to start over again.

My original lender is now out of business and now the loan servicer that originally filed the Notice of Default and pursued the foreclosure is now out of business...so who will be responsible now for refiling the Notice of Default?
