There is a terrific new decision out in our Florida Fourth District Court of Appeals.  The case is Henderson v. Litton Loan Servicing, No. 4D10-1167, and it was decided on July 18, 2012.  The decision is here:

What is great about this decision is not so much what the decision held, since this case holds what a lot of other cases are holding.  Instead, it is the simplicity and starkness of the decision.  The note was made out to a particular entity other than the plaintiff and wasn't endorsed in favor of the plaintiff.  Thus, the plaintiff could not possibly be the holder.  End of subject.

This is a very concise decision that might be very helpful to defendants everywhere presented with this exact issue.
