has anyone looked into planned unit development, look it up, I think it might be of interest

in looking back at paper work my little city is a pud. when signing papers this was described to me as a statement  that all in the community are responsible for the upkeep on our property.

Over half of my streets homes went into foreclosure.

9:  A "City" cannot be a "PUD".  "PUD" stands for "Planned Unit Development" and is usually a non-conforming use (density) that requires special approval, and in some states, offering statements or registration as a "security".  A "PUD" will also need FHA, VA and Fannie Mae approval if any mortgages are to be negotiated under those agencies/GSE.  A "PUD" must also be comprised of contiguious tracts of land and can only be developed as a "single entity".  There can only be one "developer" and if the project is sold, there must be a transfer of "developer rights".  A PUD will often contain CC&R's.  There is no government in a PUD.  Most PUD's are ruled by a POA.  I believe you are confused and are using the word "city" erroneously.  The fact that many homes have been foreclosed on has nothing to do with being a "PUD" unless the POA is foreclosing for not paying the assessments.  I would really like to know your state of residence, if you would be so kind to disclose it.

In case you are actually looking for answers, I will try, one more time, to direct you.  Since this site is for people dealing with mortgage servicing fraud, this is not the forum you should be at.  You could possibly get some help from http://www.ahrc.se/new/index.php/src/home.  Please let me ask you these questions:

1.  Is their a government entity that has control over your "city" that is given legislative authority, such as a mayor,supervisor  or council?

2.  Do you pay property taxes?  What do your property taxes cover?

3.  Who removes your snow in the winter?  A private contractor? or "City" employees?

4.  Do you have police that "patrol" your streets?

5.  Do you have parks or lakes that ONLY the people of your "city" can use?

6.  Do you pay maintenance to any "Association"?

7.  Are you governed by a "Board of Directors" who decide whether you can have a satellite dish, a clothesline, and what color you can paint your house?

8.  Do you have a "declaration"

9.  Are there any covenants or restrictions in your deed?

10.  Are you confusing being a "PUD" with being in a "PUD" allowable zone?

11.  You stated that you signed "papers" stating you are responsible for the maintenance of the roads in your "city".  Was this a membership to a POA?  Possibly a statement that you received your declaration? 

12.  Can the general public (i.e. people from other states, as an example) travel your roads?

I really believe you are a "PUD" (possibly with the name "village" somewhere in the name of the development) within a "City".  These real estate terms can be very confusing when you start trying to decipher what you purchased, but there is assistance out there - just not here at this site.

Knows About PUD
One of the key distinguishing features of a PUD, which is typically addressed in a PUD Rider to the mortgage or deed of trust, is that a PUD may very well have a contractual or other legal priority claim for assessments, charges and/or fees which may be senior to the mortgage.  Such assessments and fees vary widely in both magnitude and character, in some instances involving condo or coop fees for general building maintenance and operation and in others expenses for maintenance and upkeep of private roads, sidewalks, medians, easements, private trash collection, perimeter security fences or security or any other non-governmental communal expenses for which propertyowners have a binding contractual duty to pay.

These may range from $100 or less per year to thousands or more per month.  And the essential nature of the communal expenses is wholly dependent upon the character of the property.

Remarkably, in some instances where PUD fees, expenses and assessments are particularly uneconomic, the property subject to such charges can drive property values to near zero or even negative.  (The idea of negative property values is counterintuitive unless and until you come face to face with a statutory responsibility for hazardous waste cleanup at an EPA designated hazardous waste site.)

One reason that foreclosing servicers often DELAY the recording of their deeds from the foreclosure sale is to conceal their ownership from such PUDs and to avoid recording and paying the fees, assessments and charges due.

To others, I am a person who has been victimized.  If you would like you may ask me a question that may or may not be on this site, one that pertains to ms fraud. I could also tell you what I have found in my past paperwork.

I can not believe that it is even hard to find help on this site. I am pretty sure you all can remember the feeling when everything started coming down in your lap.

I want to figure this mess out just as badly as some people here but you can not do it on your own or without others knowlege.

h gosh: As you may have guessed by now "9" does not live in Minnesota as she claimed. It's Markana Smith of O'Brien Florida and she's looking for a new residence of the government supported style and mistakenly thought PUD might be an answer.  Two of the three people she shares a trailer with are on government entitlements. Three of the four are of age. Her son whom she coerced into helping her criminally vandalize her foreclosed AMC home is of course too young to work.

This is why all 12 of your above questions on her PUD status went unanswered.

Did you give any inside information to EMC about Jack Wright?   As you know Jack had a better than average position that suddenly made a turn for the worse at about the same time you were in the process of reporting other unhappy EMC customers/MSF posters to none other than EMC/Bear themselves! This I do know for a *documented* fact via a high powered law firm in Florida (Name available). The part about you including Jack Wright along with other EMC victims in MSF is speculation on my part. But your timing is suspect.

 

 

1) H Gosh as far as I know Markana Smith did not give "testimony" of anybody or any sort to AMC, Ameriquest, EMC, or Bear Stearns. Calling attention to certain MSFraud posts, poster(s) by name with dates and locations of certain “slanderously libelous” (sic) posts is a far different matter.

2) By all means get any new important unrevealed mortgage information out. I strongly suggest you use News Releases to the printed and electronic media rather than posting it on MSFraud. Since Markana Smith and her akas are doing 85-90% of all posting in here the demographics consequently appear to be less than credible.  (We now appear to be a forum chock full of low brow third grader squabbles) Go with multiple News Releases to at least a half dozen major outlets. Follow that up with personal phone calls to these venues to check and verify they got your information.  

 

One of the things that is generally (Not always) consistent when someone is falsely accused is that the person telling the truth insists on getting to the bottom of it. If the “other side” begins scrambling to get off the subject they often (Not always) have something to hide.  

 

This is a wee bit tricky since Markana has made a threat of bodily harm to me through one of hundreds of akas she uses; this threat was made by Markana aka “Sara.” But my primary concern that I will be further recklessly and unjustly publicly defamed (Again) by what I believe is a very emotionally disturbed person. She has a long history of attacking people online and is insulated by the fact she is judgment proof with a significantly negative net worth. Look what happened to her own attorney and even incredibly her own presiding Judge!

I guesss the question that I should has asked is by signing that rider, what if any impact has that had on what is happening.
mtg. company overpaying on insurance and taxes, late fees when not late, overpaying payoff previous mtg. when refiing,my mortgage being sold just one day before the bank bailouts in 07, the list goes on.

h gosh, I have nothing to hide, go ahead and find out who I am.
