Here is another great decision out of Richmond County, NY.

* Plaintiff Onewest Bank, FSB moves for partial summary judgement and its denied and defendant cross-moves for defensive summary judgement and its granted! 

excerpt:

"The plaintiff cites a multitude of cases purportedly holding that possession of the physical notes establishes its standing to commence this action.4 But each of these cases predate the Appellate Division, Second Department’s decision in Silverberg."

"Here, as was the case inSilverberg, MERS lacked the authority to assign the underlying notes. Consequently, how theplaintiff came into possession of the mortgages and notes in this case is suspect."
 
NY is leading the way, hopefully all the rest of the states will follow....
