Yves Smith posted an article today titled: "New Tactic to Silence Foreclosure Abuse Critics: Sue Them."  She profiles an attorney from Florida, Matt Weidner, who is being sued by National Title for slander and libel because he posted the video depositions of the National Title employees.  Additionally, she mentions a foreclosure defense attorney in Washington state that has been sued by a big law firm.

One thing I would like to mention is that the story on Crystal Moore and Brian Bly was first reported by Susan Taylor Martin of the Saint Petersburg Times in 2009.

I like Yves' statement that by suing Weidner, National Title has opened itself up to discovery including depositions of top level management.  I hope Weidner takes advantage of the opportunity and hammers them.

I am so glad someone has reposted the videos although it's in contravention of the "gag order."  If anyone has not downloaded them yet, now's the time. 

We need Anonymous and the WikiLeaks hackers.  DDoS, anyone?

The Florida Court's gag order cannot possibly apply to a NON-PARTY.  Though I haven't yet found a need to re-post any of these videos (given the vigilance of others), I would challenge the Florida Court to try to exercise its jurisdiction over ME in Pennsylvania.

If Nationwide Title Clearing wants to be suing folks outside of Florida, they are going to need to bring suits individually in the state courts where those posting reside OR they would need to bring an action in Federal Court.

The point about discovery is actually spot on.  While National Title Clearing might get a little traction in a friendly forum such as Flordia, if they want to bring a suit in a foreign jurisdiction, such as Pennsylvania, or in Federal Court, someone is going to show them the wonders of both written and oral discovery.

I think that this firm just made a really MAJOR BLUNDER bringing a suit.  First, they simply heaped new attention on themselves, drawing renewed attention to the video depositions which had fallen out of public discussion.  Second, as observed, they have exposed themselves to discovery.

When the civil discovery is completed, I would think that criminal prosecution is very likely to follow.

I wonder if anyone has filed a complaint against Nationwide Title FL Notary Bryan BLY yet.  If not, NOW would be the time!
