When a Federal judge is reviewing a Motion for Summary Judgment does he review the entire case docket?  Also, would the judge review the previous Federal judge Memorandum and Opinion when considering his on ruling? Our case had been assigned to a new judge the defendants filed a Motion for Summary Judgment. Our previous judge had already denied the defendants Motion to Dismiss twice.

You should never assume what a judge will or will not do.  If there's a MSJ on the table what does it say?  Is there a MOL that goes with it?  What does it say?  You need to object to the MSJ and set forth in your MOL the reasons why MSJ is not appropriate.
