Mortgage Servicing Fraud
occurs post loan origination when mortgage servicers use false statements and book-keeping entries, fabricated assignments, forged signatures and utter counterfeit intangible Notes to take a homeowner's property and equity.

Rising numbers of law suits are popping up all over naming Litton Lawyers and their firms for everything from fraud and malpractice, to civil rights violations.

Litton in greed to foreclose fast is revealing itself as a master in fraud and deception by "Creating" its own legal documents to fit each case.  Cutting and pasting operations are busy at work at Litton Loan's legal department; only problem is, some of Litton's Lawyers are now seeing they could, and some already have, become targets themselves of fraud, suits all egging such actions.

Goldman has to address the "LARRY" problem and quickly, a good signal that they are not business as usual would be a very public announcement that both LARRY SR and JR  have left the company, but not with any golden umbrella!  Otherwise, Goldman could very well see them stuck with a "Tar Baby".

And yet another Class Action is being filed out of Alabama against Litton Loan, and CBASS!

Where did you get this from?   I'd love to read it....

any more info on the class action from Alabama a newbie.... to this and not sure how to find the info....

Thanks for any help!
This is the company who has made my life miserable for just about 4 years!

Nye Lavalle
gary,

why not list each case and get PDF files if you can to list on site for each suit the scum are involved in!

Nye, there are over 1500 suits in the federal courts right now with Litton Loan, This number does not reflect any state courts, I like the idea of posting all the case's by state, and then by Federal courts.  I'll consider that, and see if someone can put that together.

The number of class actions filed, vs those certified also maybe a good informational post.

I know that CBASS is beginning to named more often in the litigation case's.  This is the company that MGIC AND RADIAN owned under a Joint Venture, I understand there are serious problems, besides CBASS being non operational, and both RADIAN and MGIC appear to have had greater control over CBASS than they currently both like to admit,  I know discussions about the current RADIAN and CBASS suit are now expanding into naming board members and some Officers.  We will have to see where they will be going with that pretty soon.

Gary - where do you get the 1500 number?

I'm trying to be rational about some of the things you say, but with all due respect, there are a total of 147 cases that have ever been filed in federal courts that name Litton Loan as a party since January of 2005. Some of those are possibly duplicates.  Only 47 of those are still active. Among that number are cases that have nothing to do with borrowers and the issue of mortgage servicing fraud.

There are a total of 4 still active that name C-BASS, 4 more in which the name "Credit Based" are still involved and 7 styled "Credit-Based."

You're not helping the cause with outlandish claims. The enemy knows the actual score all too well, and trying to hype the issue only diminishes our position and makes people who are suffering think there is some kind of issue they can bring to bear in their cases.

No wonder most attorneys are reluctant to touch a typical victim's case. People come in and tell them things like you post and the lawyers soon discover they're nothing more than urban mythology promoted by people with an axe to grind on the net.

I don't know what you're getting out of saying some of the things you post, but you're making victims look like fools where it really counts.

Moose, run a PACER check, on the Federal Courts, many cases also include other plaintiff's or defendants, not Litton Loan standing alone.  When you combine the only Litton Loan with cases they are named as other named defendants you will find well over 1500 in the federal courts.  You need to also look where other defendants are named, and the total list is over 1500 in the Federal Courts, and several hundreds more in the state courts.

Sorry, Gary, but you're confused.

The numbers I posted are from PACER.

Any named party to a suit will appear in the searches whether or not they are with other parties. That's how the PACER system works.

Please point out what you're using as a source for "1500."  I suggest you provide the exact PACER query you use to find that number so that people can attempt to replicate your findings.

Moose is your real name David Mortenson?  Were you ever a victim?

I have read of your posts, and quarry you about your background?

David, could you tell me how your using your PACER quarry?  They total is more than 1600, I suggest you recheck your PACER,  In Wisconsin there are over 200 state files alone.

David, send me your PACER quarry and I will tell you how to use it, and find the cases.

By the way David I post under my own name and stand my what I have posted and said. If you want to suck information out of me, I suggest you call me, your living in a glass house, David!

Note that a PACER query includes all instances of the name "Litton Loan" whether or not they're the first named party in a case or not.  And there are duplicates (i.e., 135, 136 & 137 are the same case). The above list starts at 2005 because there are only a handful of cases from prior years that are still open, and most of them are a single related case.

PACER does not have state court cases, however, the standard approach on any servicing-related case is to have it removed to federal court.

If there is a second date shown, then the case has been closed.

OK, moose this is where you made your mistake, you only ran LITTON LOAN on the search, the case's you cited are "Stand Alone" cases, you have search all the case's that include additional Defendants, such as Bank of America, CBASS, Litton Loan vs Gary Wait, or Salomon Brothers, Deutsch Bank, Litton Loan, CBASS vs Gary Wait.   You must run the additional Defendants or Plaintiff's,

But you know that, so why are you trying to take me on?  Could it be you have other motives David?  Working both sides of the street maybe.

More FYI, if you run Litton Loan in Wisconsin courts, you find none!  However when you run Countrywide, you find Litton in many litigation case's or Bank of America, Litton Loan again is either a defendant or party to the plaintiff, but I think you know they only go by the first name of the plaintiff or defendant that is listed.

So David working both sides of the street?

And which of these has Litton involved in it?  There's only one Countrywide case that is still active, and it involves Stuart Title. And there's one active case against Bank of America and it doesn't involve or mention Litton.

If they're there, why not just cite or list the Wisconsin Federal cases you're referring to so we can look them up on PACER?

I'm not defending anyone, Gary. I'm pointing out that people who would take their case to an attorney and say that there are thousands of cases against Litton in Federal court are going to make themselves look foolish.

Moose,

I don't know what you are up to but you're barking up the wrong tree.  This I can guarantee.

I don't believe anyone can be this ignorant.  Type in Deutsche Bank and you'll be displeased at how many cases Litton and Deutsche Bank are co-fraudsters.

Why not post in your real name.  We know who and what you are.

David I don't know what the hell your trying to prove.  I have never said "Thousands" I have been said between 1500 and 1600 in Federal Courts.  I don't know if your serious or just ill informed on how PACER works.

As for Countrywide, I just checked Wisconsin, there are over 124 litigation cases in Wisconsin listed.  I suggest you use the Wisconsin Court Access, its free and lists all the circuit courts.  And check it.  Now if you run individual banks hundreds more come up, and you will find a large number of them include Litton Loan either as an additional named plaintiff or defendant.  You really do need to know how to do these search's before you confuse and mislead those that visit this site, the importance of "Accurate" information is critical to those that visit this site.  I also noticed that your searches that you listed did not include some the class action suits, I did not see the  2 CA, suits, or the one filed against RADIAN AND CBASS, or the Katrina victims, and subsequent suits against SOUTH WEST BUSINESS.

David, remember the glass house and throwing stones.

Incidental David, BANK OF AMERICA has over 500 litigation case's in Wisconsin, again refer to WISCONSIN COURT ACCESS, and type it in for yourself.

Nye, there are over 1500 suits in the federal courts right now with Litton Loan, This number does not reflect any state courts, I like the idea of posting all the case's by state, and then by Federal courts.  I'll consider that, and see if someone can put that together.

That's your post, Gary. The issue was Federal courts Gary.  I'm confident there are far more cases that involve foreclosures in state courts, particularly in those states that have judicial foreclosure, but many of the key issues that drive msfraud don't stay in local courts and not all victims wind up in foreclosure.  Many people are simply being abused and overcharged and threatened with foreclosure.  If a servicer is sued for fraud, they are going to remove it to Federal court for diversity reasons, and that's where the numbers from PACER come from.

The list of FEDERAL cases you suggested is now on this thread. I pulled it as a result of the above post you made.  There are, as I noted, still a number of active cases. But there are not anywhere near 1,500.  A few states don't have local court record access - in fact, Oklahoma's supreme court just pulled the plug on public access because of privacy concerns.

This isn't to pick a battle, Gary.  It is to be accurate in what we claim and what this site represents - the truth about msfraud. Hyperbolic statements and claims may make people feel better, but they don't really help the casual visitor who comes along and sees something, then passes it along as if it were fact and then finds out it wasn't. It starts making everything here sound fishy.

David, you really need to check your sources before you begin making accusations that are incorrect, I note, now you are changing the subject back to the original post I replied to Nye.

I am in agreement with his idea, of listing and posting the litigation by states then by Federal Courts, I was indicating that a problem exists on doing the research as accurate data may not be available to use, as your use of PACER, showed in accurate information about the number of cases, as well as the number of Wisconsin Cases.  Many case's and jurisdictions Litton Loan maybe named as a "Third Party" action, but not listed or in any computer data resources, That's why, it would take a long time and process to review every file, in order to complete this process.  However I think it remains a very good idea, just that I don't see it occurring quickly due to how I know the data basis's are operated, and data stored on different sites.

Next time David, before you jump on someone I would check them first before making some really "Dumb" statements to make yourself look good.  Or is their really another motive you were attempting to accomplish?

Bob, since you obviously have PACER and know how to use it, what is the number of those Deutsche Bank cases you come up with from January 1, 2005 up to now.  Please post the results if you don't mind. Let me know if you can't and I will.

And how many is Litton a party to?  That answer is still 147 cases in Federal courts that have PACER filing and retrieval.

If the name "litton loan" is formally filed as a party (defendant or plaintiff) in any Federal lawsuit, the case will appear in the list as a party on the PACER system.

You can't "hide" a party to a Federal case.  If they are a party (1st, 2nd, 3rd, 4th, whatever, they will show up in PACER, even if they've been dropped.

Here's an example of a case with a large number of parties:

It's not mysterious magic, guys. There's no hidden agenda in reporting raw numbers of cases. It's the way the database works, and don't try telling people the subject was changed. It wasn't. It hasn't. I asked Gary where he got the numbers because they didn't match up with what I found on the system.  He then proceeded to attack me as some kind of industry shill with a hidden motive.

That's not only insulting, but to the people here that know what they're talking about it makes you look childish.

Things are bad enough without having to make stuff up.

David, go sell your book.  Knowing only a little information makes a person dangerous when they display the little they know, and trying to argue over numbers of litigation cases, I showed you three you did not have listed, then you made the comment about Countrywide in Wisconsin, and then Bank of America, The numbers you posted were obviously far apart.

And yes I suggesting a motive, I'll spell it out so its very clear, your post was an intentional post in an attempt to "Discredit" information I posted, your post came one day after I had just won a "Significant Summary Judgment" against Litton Loan allowing Punitive Damages against Litton Loan, I don't find that a coincidence.  I was waiting for someone to post something shortly after we won the motion against Litton Loan for "Economic Diversity"  The Judge ruled in my favor and Punitive Damages are now on the table against Litton Loan.

So the question I have to you is simple, are you working both sides? And if your so sure of yourself why not post under your name?  Many on here do, I sure as hell do, and continue to stand by my statements here.  If you would like to do us all a service, you could begin to put the information together for us.  It would seem a good project for you, and when your completed it would help us all, so why don't you do it? Then we can ask questions of your sources for coming to the numbers you arrived at, and if the documentation stands the tests of being challenged here.  It appears to me that your the perfect one to perform such a service, with your background.

How funny that Noel T Winter is a petitioner against anybody.  He is a fraud and has stolen not only my money, but there is a long line in front of me as well as behind me.  Yesterday, I was called to give a deposition in the case against him here in Florida.

About ten years ago, he was arrested and charged  and convicted with theft in South Florida.  He was forced to pay back the money to his multiple victims as a part of his release.

Six years ago in Central Florida, he began his old tricks in a new place.  The State first fined him $5000 for representing himself as a seller and attempting to sell homes that he did not own. Not even one month after this administrative decision, he continued to do the same thing.  I was a single mom and first time home buyer.  One of my close relatives had died and had given me some money.  I decided to buy a home and through a series of phone calls got caught in Mr. Winter's web.  Long story short, prior to closing he showed up to my job seeking a check for closing cost.  Then on the day of closing everyone showed up to except him.

Local news station channel 9 did a piece on him in November of 04 exposing him.  That's when I learned that there were several others whom he also robbed.  One such lady lost about $22,000 in dealing with him and she was so depressed, sad and embarrassed.

Now of course I sued the bastard, and he told my attorneys that he would drop off a lump sum of money as a settlement, but before the stated date, he skipped town to California.  He also skipped out of town on the criminal case that was brewing against him as well.

Recent update! Mr. Winter was arrested in California and brought back to Florida to face multiple felony charges. My mission is to round up all of the victims so that the DA knows what is at stake.
