Justice Arthur Schack of the NY Supreme Court for Kings County gives us another delightful display of his flair for justice in dismissing a tax foreclosure with prejudice.

The case is:
NYCTL 2005-A v Arias, Index No. 2006-23043, 2011 NY Slip Op 50914 (NY Sup. Ct. Kings Co. 2011)

It seems that  plaintiff's counsel was once again seeking to withdraw a motion of this five year old case, but without giving any explanation to the court.

Justice Schack took exception to the attorney's letter to the Justice which included this admonition:
"THIS LAW FIRM IS ATTEMPTING TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE."
Other law firms have previously discovered that sending threatening letters to Justice Schack can cause problems!
