Homeowner finally gets 1, in HSBC v. Valentin.  This is a case that has been going on since 2007, Appealed and remanded and now finally dismissed by Judge Schack.  Since NY has a statue of limitations of 6 years on notes that have been accelerated, This case might finally be over.  

Hopefully the Valentin's followed Mr. Ropers advice and locked away the original intent to accelerate letter, if so, HSBC no longer has a claim to foreclose on the mortgage.  The lien still exists, but the banks remedy has just been extinguished.
