I don't mean to come across as a skeptic, but motions to dismiss are not decided by evidence at all.  All survival of this MTD means is that the plaintiff (injured borrower) has made a facially valid claim.

Actually proving the allegations and winning the case is something completely different.  The fact that foreclosure defense advocates are celebrating this decision reflects just how bad off we are! 

Survival of a MTD is NOT a "win".  It is merely an absence of loss at a very preliminary stage.

Best of luck and success to this dispossessed homeowner!  But this homeowner already LOST her home and nothing in this decision gets her much closer to recovering the lost property.
