 After 18 long months of battling eviction, I was just granted a restraining order from a supreme court judge preventing sheriff from carrying out 72 hour vacate notice.
My order to show cause reflected the fraudulant circumstances under which the sheriffs sale took place after foreclosure, as well as lack of notice given to me.
This was first opportunity to have my side heard, in that it had been inadmissable in landlord tenant proceedings. This obviously gave me and my case some some validation. I am looking to have sale set aside, but want to know if I can also claim damages and seek restitution.
