H Gosh,, The anger is growing within this country, about the betrayal, and out right corruption of Government and Officials, as well as regulators that were put in place to prevent these crimes from occurring! 
 
As long as these people are able to walk the streets amongst us their well be serious problems.  This did not occur over night, it took years to create, modify, and refine into the existing "Manufactured Foreclosures".  The Federal Government has spent more time defending the corrupt banks, and their officers, and directors, than the individual families. 
 
The war here in this country is more serious than  what our troops are fighting oversea's.  They may not have homes to come back to, or their family members may have lost theirs.  The questions then begin to start what are they fighting for?  A very serious problem faces every elected official in the coming years, because we are going to be asking  "What did you do to prevent this?
 
Vote them out, IMPEACH SEN. DODD! Lock up Larry Litton Jr. and Sr. 
 
Its a national crisis, and now has effected nearly everyone, or someone they know.
 
And still States, and Federal Government Officials are getting paid, so all is well with them! 
 
Its time for a change!  And I don't see it coming from either of the two major political parties!  I myself, have been mostly a life long Republican, but as in an email to Sen. McCain, "The Party left me..."  so I signed up with BOB BARR, my vote may mean nothing but I'm not supporting any of those that got us to this point.  Both Dems. and Rep.  are responsible.
 
Keep up the good work Mike!  We are doing with the Government was meant to do, exposing the corruption and crimes of servicer's, and where and who benefited from this American Crisis!
 
And H Gosh, keep up the vigilance too, its people that contribute large and small to this site that are making a difference.  A vigilant people, is our only hope of turning this crisis around and hold those responsible to the fullest extent of the law we have to work with.

Does anyone ever think that CEO FOLEY  of Fidelity would ever appear before a Senate Committee before Sen. DODD, and answer a couple questions. 1) Did Fidelity use its computer network to financial institutions to advance, sell short, to reap hundreds of millions of dollars within the past 7 years?
 
2) CEO Foley, identify the business and personal relationships of MGIC/GOLDMAN/COUNTRYWIDE/BOA/AND BEAR STEARNS.

What the hell are we fighting for?  Is it protect our right to become debt slaves for the greedy rich of this country, or could it be to preserve what has become the status quo, where those currently in power regularly sell out the very lives and livelihood of those who are responsible for maintaining and supporting the very rights and freedoms that they have abused by thieving from the working citizens of this nation in order to satisfy their own absurd selfishness?

I truly wonder just who do they think is going to be fighting their battles in the future once the truth is known? 

Who's going to bail out all the corporate, criminal gravy trains that they have founded in order to satisfy their own greed, self-indigence, and sadistic and inhumane treatment of others, once they and their families have been exposed to be the absolute classless leeches they are?

I couldn't agree more. If our President was anything like the person he claims to be, he would be completely outraged and disgusted with the criminal acts of those who have destroyed the lives of so many honest Americans. But instead he makes excuses for their acts and belittles those whom they have victimized.

He and Dodd have much in common, and hopefully one day soon they'll have the time, a very long time to discuss those commonalities from adjoining prison cells.

Fidelity has changed it name up at the Mendota Heights, MN office.  It is now LSI, Inc. which is Lender Services, Inc. Still owned by Fidelity out of Jacksonville, FL.

Fidelity is a big one - remember they service 19 out of 25 of the largest mortgage companies in the USA.  Watch out for Home Loan Services, Inc. out of Pittsburg, PA too.  They are doing the same thing as Fidelity.

Fidelity National Information Services, Inc. spun off their "Bankruptcy and Foreclosures, Inc." division into Lender Processing Services, Inc.  But big time SEC violations in how they did it. Knowingly they are going down for the huge fraud with the foreclosure lawfirms.  All three companies have the same address: 601 Riverside Ave., Jacksonville, FL.

I seem to recall some golf outings were CEO's of FIDELITY, MGIC, RADIAN, Mike Milikan etc came together in Florida a number of years ago,  I'm still trying to find out what CEO Curt Culver of MGIC did with the new Rolls Royce, I have asked here several times, but no one knows.  mmmmmm
 
Maybe Larry Litton can answer that?  Or even Paulson former CEO of Goldman? Anyone not believe this was not planned?  Including Paulson's three page plan!
 
The Government is going to be running out of money maybe before the end of the year, a new debt level is going to be asked for and granted!  So we all will be digging deeper soon.

Fidelity National spinoff makes money from bad mortgages

JACKSONVILLE — As long as foreclosures and bank consolidations continue, the most recent spinoff child of the Fidelity National family will be fed by growing revenue despite a battered mortgage industry.

Lender Processing Services Inc., a five-month-old spinoff of Fidelity National Information Services Inc. (NYSE: FIS), is gaining revenue through its new technology, products and services that help lenders process foreclosures, perform loan modifications and provide risk management tools.

The company (NYSE: LPS) already services more than 50 percent of outstanding first mortgages in the U.S. at its headquarters at 601 Riverside Ave., executives said. It expects to reach 60 percent market share once it converts JPMorgan Chase & Co. (NYSE: JPM) onto its servicing platform. This will increase the first mortgages on its system from 27 million to about 31 million, said Jeffrey Carbiener, president and CEO of LPS.

The company also signed a multiyear consulting agreement with Wells Fargo Home Mortgage, a subsidiary of Wells Fargo & Co. (NYSE: WFC), to help the lender manage Wachovia Corp.’s $118.7 billion Pick-A-Pay portfolio when the acquisition closes.

LPS has an advantage over competitors in that it targets loan origination business when home sales are high and foreclosures when the housing market is struggling, analysts said, but there are risks associated with the mortgage industry.

“When we were a segment within FIS, the mindset was you’re in the mortgage business, therefore you’re like a title company, subject to those swings,” Carbiener said.

But the company’s business is broader than that. “First and foremost, we’re a technology company,” he said. “We’re that core platform that these lenders rely on for all aspects of their operations over the mortgage life cycle, and that gives us a great ability to balance revenue and margin streams.”

Revenue from LPS’ processing and services was nearly $472.7 million in the third quarter, up 11 percent from the consolidated revenue when LPS was a division of FIS the same time last year, according to its recent filing with the U.S. Securities and Exchange Commission.

Outsourced help

In general, LPS provides an outsourced system that helps lenders originate loans, service loans until they are paid in full or process foreclosures. In the case of foreclosures, it helps the bank during the time it is managing the property until it sells the house.

The company has 29 types of services. Its top 10 lender clients use an average 17 of those services, Carbiener said, and he wants to increase that average.

As LPS looked to expand its technology platforms in 2005 to 2006, the company built a foreclosure platform and most recently a home equity line of credit platform. LPS can now convert home equity lines of credit to its mortgage servicing platform and recently announced its first major signing with Wachovia (NYSE: WB), which will transfer to Wells Fargo.

Default services represented $608.1 million, or 44 percent of the company’s $1.39 billion in total revenue, excluding the corporate segment for the year-to-date 2008, according to an LPS presentation made at the Bank of America Securities Credit Conference in November. By comparison, revenue from default services was $216 million, or 16.1 percent of the total $1.38 billion in revenue in 2005 when LPS was within FIS.

The company also is working on expanding its products side, in particular with risk management, where a database would be able to predict the likelihood of default or prepayment on a mortgage. Carbiener said there is still a need for such data.

“You would think that the loans that were made in 2008 thus far would be much higher quality than the loans that were made in 2007” and before then, he said. “But if you look at the early delinquency rate on the loans that have been made in the first part of 2008, it’s the highest early delinquency rate of any vintage of loans looking back the past five years.”

The company’s gross profit was about $170.6 million in the third quarter, up 4 percent from the consolidated number the same period last year, according to SEC filings.

However, net earnings declined 25 percent to nearly $51.3 million in the third quarter of this year compared with the consolidated number for the same period in 2007.

LPS was down, but not by very much because it’s benefiting from the foreclosures, said John Craft, senior analyst at D.A. Davidson & Co., a financial analysis provider based in Great Falls, Mont.

Craft said one of the risks for LPS is if the government places a moratorium on foreclosures. “For every loan not foreclosed on, that’s lost business for these guys.”

Craft rated LPS “neutral” in the latest report on the company Oct. 30, primarily because of the anti-foreclosure regulation. The “neutral” rating means a zero to 15 percent return potential on a risk-adjusted basis for the next 12 to 18 months.

Focus on reducing debt

The company spun off from FIS as a completely separate entity July 2. It has 6,700 employees, with 1,500 in Jacksonville.

LPS also took on about $1.6 billion in debt from the spinoff. Carbiener said the company’s focus right now is to reduce its debt; it has committed to paying off at least $140 million each year.

The company expects to grow revenue by 6 percent to 9 percent annually from 2009 to 2011.

Now, Carbiener said LPS is focusing on the front end, loan originations and refinances again. “There’s not a lot of volume there now, but our view is we want to be positioned with these guys when they start making loans again.”

Regardless, the cat is out of the bag regarding the "Networking" agreement, it is now becoming a large legal problem in many area's and states, I know for certain, that a number of large plaintiff firms are looking at aspects of the agreements for possible other class actions.

Don't give up on this set back too quickly. In the details much of the case was lost because it was filed in bankruptcy court. Where it should have been filed in state circuit court (or where the foreclosure was related to the bankruptcy). The complaint was written poorly, had legal errors in it.

Bottom line is Fidelity National Services, Inc. and William Foley and the rest of the executives are absolute crooks. They are doing illegal things, hiding from the courts. Don't be afraid to challenge them, get a good attorney and they can be beaten.

OJ, thanks for the insight,  from what I have heard from others that are reviewing the case now, is similar, and it was dismissed for failing to state a cause of action for which relief could be granted. 
 
I'm hearing from those reviewing the file, is that the door maybe opened for a number of other cause's of action against Fidelity, and the law firms they retained, and the lawyers that filed appearances on behalf of lenders, and not disclosing that Fidelity as the client.   I'm  guessing this is going to be another source for Plaintiff's class actions within the near future.

Don't jump too quickly.  I download a significant number of the related case files.  It does not appear at first glance the case was dismissed.  What did happen is the case was taken out of the bankruptcy court and filed as a civil action in Texas District Court. 

Note the new case numbers listed below (highlighted).  I'll try to track down tihs case but it sure looks like the case is now in the US District Court for the Southern District of Texas.

I can not find any information as to why this case was mutually dismissed.  There is a motion for reconsideration filed by Fidelity.  It they were denied they may have decided to settle.

LPS Sees Fee-Splitting Lawsuit Dismissed

A highly-followed and publicized case involving the former Fidelity National Information Services (FIS: 16.72 +3.79%) and the current Lender Processing Services, Inc. (LPS: 24.30 -1.74%), centering on allegedly improper fee arrangements involving the servicers and attorneys the company works with, was dismissed Wednesday morning by the Houston-based judge presiding over the case, HousingWire has learned. The case had been seen by industry insiders as a litmus test for the firm’s core business model; LPS maintains the nation’s largest mortgage default management outsourcing operation, among its other businesses.

Judge Lynn N. Hughes, who presides over United States District Court in the Southern District of Texas, signed the dismissal order Wednesday, the same day lawyers representing LPS filed a motion to dismiss the case, a review of court records show.

The news comes as a huge win for Jacksonville-based LPS, which had been under attack in the case as garnering illegal “kick-backs” of fees charged to attorneys on behalf of the servicers the firm works with. Known in the industry simply as “the Harris case,” plaintiffs Ernest and Mattie Harris had sued Fidelity National after learning during bankruptcy proceedings that the firm was collecting a fee to provide administrative support on behalf of Fort Worth-based Saxon Mortgage Services, now a unit of New York-based Morgan Stanley (MS: 16.50 +2.29%).

The case was largely watched by industry insiders, who had suggested a ruling against Fidelity National/LPS could significantly alter the landscape for default servicing. HousingWire Magazine ran a feature story on the case in our inaugural print issue, in Sept./Oct.

Judge Hughes dismissed the case with prejudice, as well, which in plain English means the right of the claimant to file another case on the claim is barred — big news for anyone in the default industry, and a strong deterrent to future legal action covering similar claims, legal experts suggested to HousingWire.

Officials at LPS had not yet commented on the ruling when this story was published, nor could attorneys representing the Harrises be reached for comment on the dismissal by Wednesday’s deadline. But LPS officials had steadfastly maintained throughout the legal proceedings that its business model helped generate efficiencies that would help servicers and consumers alike. LPS spokesperson Michelle Kersch told HW in September that the firm’s fees cover services, including software it provides, that make it easier to track files, documents, payments and “other important issues related both to bankrupcty and foreclosure matters.”

Strong results from the firm’s default management business helped propel LPS to a $51.3 million third quarter profit, largely offsetting revenue declines in the firm’s origination-centric business lines due to the ongoing mortgage market mess. Operating revenue in the firm’s default-related businesses had risen nearly 98 percent from last year’s levels by the end of Q3.

LPS was recently spun-off from Fidelity National. Shares in LPS were at $22.21, up 3.49 percent, on the New York Stock Exchange when this story was published.

Housing wire is pro mortgage servicers and note the time the judge signed the order to when housing wire posted a "positive spin story".  Some attorney for Fidelity must have called and got the word out right away to prop up the stock. Make no bones about it - these guys are the maifa. They took all kinds of illegal payments from law firms. Have to wait and see if the suit is going on yet in civil court but Fidelity is no better than Al Capone - worse as it is a national scheme.

The pooling and servicing agreement requires the servicer to forward payment to the securitized trust regardless of whether the borrower is making the mortgage payment.  This must continue until the loan is removed from the trust, and that can only happen by foreclosure.  This seemed like a great idea when these securities were created at the height of the subprime-lending craze, but with homeowners unable to pay the exploding adjustable payments, servicers are hemorrhaging cash and going under.

Because there is an incentive to default the homeowner and get the home through the foreclosure process as quickly as possible, servicers and default servicers hire law firms that promise speed as their top priority, even at the expense of truth and justice.  Literally, law firms receive a score from Fidelity National Default Solutions, known as an Attorney Performance Report (APR), for the speed with which they dispatch homeowners from their homes.  The top performers receive the prestigious Summit Award, bestowed annually at Fidelity’s annual meeting, but those firms who do not meet an acceptable foreclosure rate are terminated.   JT
