Ed Harris filed a class action lawsuit in Houston, TX (Federal District Court) in January of 2008 against Fidelity National Information Services, Inc. Twenty-eight days later FNIS announced they were spinning off their foreclosure and bankruptcy division. WHY? Because they have their dirty criminal hands in 95%+ of all foreclosures and 50%+ bankruptcies in the USA. July 1st-3rd it happened (Google it) where Fidelity National Foreclosure Solutions became LSI, Inc. which stands for Lender Services, Inc. which is also aka Lender Processing Services, Inc. The mortgage lenders RARELY foreclose on you even if their name is on the top of the lawsuit as Plaintiff. The mortgage companies, I'll pick on Wells Fargo, hires FNIS (or now LSI) to do the dirty work. LSI then has foreclosure mill law firms across the USA sign "Network Agreement" contracts. They are illegal because LSI controls everything in the lawsuit for the Plaintiff, they call the shots and have control over the law firms. The law firms in turn pay kickbacks to LSI (or Fidelity, FNIS) which is illegal. LSI, FNIS keep hidden from you the defendant, from your attorney, from the Judge/Court, from everything. LSI and FNIS haven't even listed the Harris lawsuit in the SEC filings. They are hiding it as fast as they can to get away from going to jail. But I know, now you do.

One thing to check is where is the Plaintiff being serviced copies of the court pleadings?  What is the physical address?  Who is really there at that address?  Is it another law firm?  If yes why isn't the Plaintiff being served?
Do all the names and addresses match in all the papers you have?  During the foreclosure did an appraiser get done on your home? If yes, who really did the appraisal?  I traced my appraiser back to...you guessed it - Fidelity National. They foreclosed in secret, they did the "independent" appraisal submitted to the court under sworn oath.

If the foreclosure went through go to the courthouse and see who is the owner listed on the deed now, what is the address, check who really is at that address. Subpoena the real estate agent who lists your home - who contracted with them to sell it?  Was it indeed Wells Fargo? I bet not.

Fraud upon the court is a solid basis to overturn any foreclosure/bankruptcy. It gives you something from the scum of Congress, attorneys, mortgage servicers, banks, even crooked Judges.

my situation exactly! plaintiff address on all paperwork is actually loan servicing company address. bank went out of business in 2001 and successor never filed assignment. it goes on and on...wish me luck!

PB is right on point on this, law firm that represents LITTON LOAN now is losing lawyers, and the lawyers are losing their license to practice law!  More are going to be exposed soon, and another class action is being prepared against lawyers that have represented LITTON LOAN,
 
On a side note, most of you already know, its been a long fight for me to expose Litton, and its former owners, MGIC/RADIAN, Well MGIC stock was down to less than $2  a share!  from their high in the mid $70's when I started.  I expect MGIC will file chapter 11 if the Federal Government does not bail them out soon! The rats are now abandoning the ship, with CBASS all but dead, Litton Loan sold to Goldman, and now Goldman is trying to figure out what to do with the well known TERRORISTS LARRY LITTON SR. AND LARRY LITTON JR.  who at this time is Las Vegas for the annual MORTGAGE BANKERS ASSOCIATION meetings.

With much more to follow, filing against the "Officers and Directors" of MGIC/RADIAN and CBASS has been done now in a hand full of Class actions, its now time to begin the strike to hearts of LARRY LITTON JR. Right on - it is more so the mortgage servicers than the brand name lenders (although they are in on it too). The vast majority of the public, media and such doesn't get it yet. They keep thinking it is the "sub-prime" mess. NO - it is massive fraud unlike any the world has seen given the scope of it all. It is criminal, it is a huge Ponzi Scheme with the government involved too.

According to reports, a 29-year-old African American male in Jacksonville, Florida has filed a 10-count 100 million dollar federal discrimination lawsuit against Fidelity National Information Services. On October 16, 2008 Case No 3:08-cv-986-J-34HTS was filed in the Middle District of United States District Courts Jacksonville Division. In the Amended Complaint, Lofton acknowledges ten separate Claims: First Claim -Employment Discrimination: Race; Second Claim - Failure to Prevent Discrimination; Third Claim - Retaliation; Fourth Claim - Encouraging violation of the FCRA; Fifth Claim - Negligent Hiring, Retention and Supervision; Sixth Claim - Violation of Gramm-Leach-Bliley Act and Sarbanes-Oxley Act; Seventh Claim — Wrongful Termination in Violation of Public Policy and the Whistle Blower Act; Eighth Claim - Negligence Defamation; Ninth Claim — Negligent Infliction of Emotional Distress; and Tenth Claim - Intentional Infliction of Emotional Distress. In his complaint Lofton alleges that he was terminated on October 11, 2007 after he reported the violations of company and client policies on August 22, 2007.  It is Lofton’s complaint that he was denied the right to work from home in on or around July 2007 or before a non African American was allowed to do so. Lofton has alleged that his supervisor verbally assaulted him on August 24, 2007 after he reported the security compliance breaches and sharing of login credentials. Lofton alleges FNIS senior managers knew millions of customers were being placed at risk to expedite the foreclosure process, increase the company's profitability and line the pockets of unscrupulous attorneys. Lofton alleges Lee Kennedy and William Foley made 22 million dollars last year and in violation to the terms and conditions in the SEC guidelines, they failed to report the security breaches and propped FNIS up with illegal kickbacks while forcing millions of customers to lose there home through these illegal expedited foreclosure processes.  It is Lofton’s argument that he was a railroaded scapegoat and the recipient of disparate treatment from July of 2007 until his termination.

OK. I have a question that I really need help with. I have Allstate Insurance. Well for a little while longer anyway. We have surrendered our house but we are still in it. We have not been served as of yet. Allstate sent us a letter stating that they will not renew our policy in April. (We had 2 Claims since 2006). Funny I thought that we carried insurance so that we would be covered in case of a disaster. We had a tree fall on our house in a severe thunder storm in the summer of 2006. We had water pipes burst in the winter of 2007. Anyway, our last insuranace payment was made by the mortgage servicer not us. We will probably be in this house until we are served. Can we get some kind of coverage to at least cover our personal belongings? I see that Allstate, State Farm, Farmers and American Family are all on the bad guy list. Anyone have any suggestions on who we can go to? Us consumers are really not safe anywhere we go.

Has your insurance payments always come from the servicer? Was your insurance payments always in escrow?

If so, than you may have to price out insurance for your home. You may have to put the down payment down to get it started. Than the insurance company will bill the servicer from then on in....Because, in the servicer agreement it will probably state that they are responsible for paying the insurance and taxes. But if you leave it up to them, they will not care how much the premiums are because some how or another they will get it out of you. It will be added to the foreclosure.

So, if I were you I would start the policy as soon as you can if this is the case.

We are in chapter 13 BK. We escrowed our insurance and taxes, but since we have surrendered our home we no longer are making mortgage payments. Therefore they are being payed by the servicer.

T&t - any insurance the servicer has on the property is basically to cover them from a complete loss, i.e. a fire. There won't be any coverage for your personal property.

This isn't legal advice - you should talk to your BK attorney for that, but if you're still on your Chapter 13 plan you may not be able to get an insurance company to write a personal property policy especially if you don't have a lease.

I don't know how true what Moose just described is true. I ONLY say this because of what happened in my recent foreclosure. I found out after foreclosure. However, Citi paid the homeowners on my home a full year in advance then actually foreclosed two months later. The homeowners policy that was paid was the same one I took out initially when I purchased home. Just because your in a chp 13 and had your payments escrowed doesn't change your insurance. Even if your now surrendering/being foreclosed the home until everything is done you should be protected I would think. Unless the insurance wasn't paid. 

Once I showed they foreclosed I  received their money back from my insurance carrier. So check with your insurance carrier. Which I thought was cool. Makes you wonder how many homes they do this with. Might be a good way to give homeowners back some money to move on with. While someone may ?? this I won't. Besides I probably got charged for it anyway when they foreclosed.

Your correct. Not to mention that the servicer may have an agreement mentioned in a prospectus if their mortgage is an asset backed certificate. The servicer has to pay the taxes and the insurance.

They need to get a new policy as I said earlier. They have to start it off first with the down payment and then the insurance carrier will bill the servicer. They just need to make sure that they give the insurance co. the correct servicer info. If they don't do that than it is as you said. They will only buy insurance to protect them.

Thanks ksu, but the problem  we have is that Allstate is cancelling us when this policy is up. Our homeowners ins. is due to be renewed in April and Allstate is cancelling us. They say it is due to the 2 claims that we filed in 2006 & 2007. The last time it was paid the servicer paid it. It wasn't paid by us because we surrendered the house some months ago. We just have not been given notice of foreclosure yet. Our problem is that we will probably still be here when our insurance expires. Is there anything we can do to keep our personal property covered. And if someone were to become injured on the property is the servicer responsible if he has insurance on the property? Just trying to figure all this out.
