Federal Judge Sara LIOI, of the Northern District of Ohio (Eastern Division), dismissed two (2) Ohio foreclosures based upon lack of plaintiff standing on 20 Dec 2007.  These opinions seem to be UNPUBLISHED on LEXIS at the date/time of this post.  These cases were:

  • Deutsche Bank National Trust Company v. Henderson; Filed 10/8/2007; Case No. 1:2007cv03069
  • Deutsche Bank National Trust Company v. Jackson; Filed 9/12/2007; Case No. 1:2007cv02753

Judge LIOI's written two page orders closely parallel prior orders by Judges Christopher A. BOYKO, Kathleen M. O'MALLEY, and Thomas M. ROSE.  The primary significance of these orders is in demonstrating the widespread acceptance of the necessity of a plaintiff showing standing throughout the Ohio bench.

Judge LIOI was appointed to the Federal bench earlier this year by President George W. BUSH.

For additional biographical information regarding Judge LIOI, please see the Federal Judicial Center's Biographical Directory of Federal Judges (at http://www.fjc.gov/public/home.nsf/hisj) or more specifically the entry for Sara Elizabeth LIOI at http://www.fjc.gov//servlet/tGetInfo?jid=3140 .
