Says :   MERS is the mortgagee of record when either a mortgage names MERS as the original mortgagee and is RECORDED in the applicable land records, or a completed and RECORDED assignment names MERS as the mortgage assignee.    My question is, what if  a failed lender was actually recorded as the beneficiary in the land records,and there is no assignment to MERS.  Can MERS  legally  be listed as the beneficiary for a foreclosure?
