MBIA has filed a complaint in NY against Credit Suisse, DLJ and SPS.  MBIA accuses SPS/Fairbanks of stonewalling, inadequate servicing, concealment, obfuscation, lying, abandonment of contractual obligations, and improperly diverting assets of the trust. 

Anyone surprised out there?

2:09-cv-07737-SJO-PJW MBIA Insurance Corporation v. IndyMac ABS Inc et al

It wasn't filed in New York.  It was a State case in California which the Defendants removed to the Federal District Court for the Central District of California - Western Division.

The case was removed on 10-23-20009.  It's a securities violation case.  It's another squabble as to which 'too big to fail' bank wants to pick at the remains of IndyMac.

Brindy - you are citing a different matter.  The complaint I'm referring to is MBIA, Plaintiff vs. Credit Suisse, et al, Defendants, filed in NY Supreme.  The post just above this will link you to the MBIA site where you can find the complaint.  Thanks Yankee for the link.
