Mortgage Servicing Fraud
occurs post loan origination when mortgage servicers use false statements and book-keeping entries, fabricated assignments, forged signatures and utter counterfeit intangible Notes to take a homeowner's property and equity.

There is a new decision out of Florida's 2nd DCA last week:

[i]Cutler v. U.S. Bank, N.A., Case No. 2D10-5709 (Fla. 2nd DCA Sept. 21, 2012)[/b]
http://www.2dca.org/opinions/Opinion_Pages/Opinion_Page_2012/September/September%2021,%202012/2D10-5709.pdf

The decision is very ordinary. It simply shows that the strategies championed by Mr. Roper still work!

I was also reminded of an old post by a Forum participant who used to post several years ago under the handle "Knows About". Knows About was pretty sharp.

He only posted on the Forum for a year or two and departed long before Mr. Roper. But I was reminded of this old thread revived by some other seniors in late 2011 and still getting an occasional comment in early 2012:

[i]In Re Wells: It is All About Indorsement and Delivery[/b]
http://ssgoldstar.websitetoolbox.com/post/In-Re-Wells-It-is-All-About-Indorsement-and-Delivery-3546460

So I thought that I would dedicate this new thread to "Knows About", where ever he may be!

Here it is three years later and it is still all about endorsement and delivery!

Borrowers who overlook that simply rule do so at the peril of their home!!

Beware of scoundrels like Mike H. and Maher Soliman. But do heed the counsel of those like Knows About who have shared their nuggets of real wisdom.

Here is another thread with a creditable discussion of negotiation from Knows About:

Have you seen this signature?

(I think he got a little cranky when someone else "Knows About Fraud" started trying to use the "Knows About" handle! Clearly, Knows About, knew about notes. "Knows About Fraud" was an imposter!)

I am very glad to see f giving Knows About credit. Knows About was a very valuable contributor to the Forum several years ago.

Like so many of the longstanding contributors ("seniors" as Texas calls them), Knows About seems to have given up on the Forum long before Mr. Roper.

I know I wasn't the only person that appreciated Knows About's contributions. Besides f, Jeff noted Knows About's contributions earlier this year in this post:

I recall that Knows About was only active at the Forum for a year of so, but he was a tremendous contributor during that period. After Sheldon's post I went looking for some of Knows About's other threads and was stunned to find that the Forum administrator seems to have deleted ALL of these except for the few Sheldon had linked. It is little wonder that Knows About left the Forum.

It is really dismaying that the Forum administrator continues to put the interests of the banks and select site sponsors ahead of distressed borrowers! One cannot help but wonder how many homes might have been saved but for the irresponsible editorial policies of the site sponsor.

I miss Knows About, too! He was pretty sharp. I do not know why the administrator deleted all of those useful posts.
