LEGAL QUESTION:

Hi, my best friend is fighting LNV Coporation (LNV) who filed their foreclosure complaint in State Court and purchased her house at sheriff sale. She then filed a direct action against LNV for wrongful foreclosure and LVN immediately filed a motion to remove it to Federal Court.

The question is this:

Did LNV waive diversity because of their initial foreclosure filing was in State Court?
