There are some great threads on personal knowledge and business records on this Forum. Most homeowners neglect the most basic evidence arguments that are WINNERS.

The same objections would seem to apply in a foreclosure where the servicer changed.  It would seem that the new servicer would have a difficult time providing the foundation for the records of a different business if the correct arguments are made.  This could be fixed by obtaining an affidavit from the prior servicer, but this would throw a huge wrench in a Summary Jundgment and could potentially be a huge headache for the Plaintiff.
