On several occasions, I have pointed out that foreclosures in New York State have mostly ceased since the imposition of the new attorney affirmation requirement by the New York Court of Appeals.

While this is readily apparant from a perusal of the unpublished orders being issued by New York Courts, the matter hasn't been thoughtfully and thoroughly addressed by the news media.

I thought that by organizing and posting links to some of the orders now coming out of Suffolk County, New York, I might illustrate the kinds of orders which are now common, replacing the foreclosure orders which were prevalent prior to the robo-signing meltdown.

Though Justice COHALAN's orders do not set forth a date certain for compliance, the order does require the plaintiff to file an updated affidavit of merit in addition to the attorney affirmation and sets forth specific information which must appear within the affidavit of merit:
"The plaintiff is also directed on any future application to provide a copy of this Court's order, the prior application/motion papers and an updated affidavit of regularity/merit from the plaintiff/lender/bank's representative that he/she has reviewed the file in this case and that he/she documents that all paperwork is correct.  The plaintiff/lender/bank's representative shall also provide in said affidavit of regularity her/his position, length of service, training, educational background and a listing of documents and financial records reviewed substantiating the review of amounts owed.  The affidavit should also include that she/he has personally reviewed both the mortgage and the note and any assignments for accuracy."

Justice Peter Fox COHALAN is NOT the only Suffolk Justice who is denying foreclosure motions due to failure of attorneys to furnish the required affirmation.  Justice Melvyn TANENBAUM, also of Suffolk, has also been actively denying foreclosure motions due to affirmation deficiencies.

Exemplary language from these orders is:
"ORDERED that plaintiff's application for a Judgment of Foreclosure and Sale is adjourned until January 18, 2011.  On or before this date plaintiff's counsel is directed to submitL 1) an affidavit or affirmation from plaintiff "US BANK's" counsel certifying that all prior submissions were accurate and correct in the underlying mortgage foreclosure action; 2) an affidavit or affirmation from plaintiff's attorney of record Steven J. Careful scrutiny of these cases shows that Justice TANENBAUM used a similar order to dispose of the motion in each case.  6 + 27 + 13 = 46 cases in all.

One aspect of this disposition was already reported.  The StopForeclosureFraud.com site reported on November 15, 2010, that Justice TANENBAUM had "suspended" thirty cases for improper submissions:

Suspended is probably a mischaracterization of these orders, and the StopForeclosureFraud site seemed to fail to perceive that the orders relating to the Steven J. BAUM cases were actually a part of a larger disposition of cases across Justice TANENBAUM's docket.  But Justice TANENBAUM very particularly DENIED the relief sought and set a deadline for correction of the deficiencies!

I will show in a future post that Justice TANENBAUM continued his aggressive dispositions in December!

It is noteworthy that Judge TANENBAUM's orders of October 12-15, 2010, imposing an attorney affirmation requirement were issued BEFORE the New York Court of Appeals imposed a statewide attorney affirmation requirement on October 20, 2010.  See "New York's New Attorney Affirmation Requirement Relating To Foreclosures" at:


As shown above in Judge TANENBAUM's orders from November, the Court expressly adjourned consideration of pending plaintiff motions for an order of reference to a specific date certain imposing a requirement that the plaintiff's attorney
certify to the court the verity of the plaintiff's pleadings and evidence.

In my previous post within this thread (02/15/11 at 5:01 PM), I identified orders entered by Judge Melvyn TANENBAUM of the Suffolk NY Supreme Court entered during October 2010.  I showed that Judge TANENBAUM set a deadline for plaintiff's to furnish an attorney affirmation.  The deadlines for these orders were mostly set to December 9, 2010.

Some explanation of the data is certainly in order.  And I must readily confess that this tabulation was compiled without the aid of the underlying documents docketed.  Rather, I have summarized the abbreviated entries appearing within the NY eCourts Docket summaries.  So in most instances, I am merely GUESSING what these entries actually mean.  And anyone with greater familiarity with New York law, dockets, and these particular cases is both welcome and encouraged to furnish a better explanation.

Disposed Cases
The vast bulk of the cases shown to be "Disposed" seem to have been older cases for which an order of reference (order appointing a referee) and order of foreclosure was entered some time ago.  It APPEARS as though these cases were languishing on the dockets.  Less clear is whether they were merely awaiting some ultimate, final disposition or whether there remained some large number of incomplete tasks.

For example, whether the actual subject property was SOLD isn't readily apparent, though this could probably be ascertained by CROSS-CHECKING the land records.  Similarly, it is UNCLEAR whether there was a judicial order CONFIRMING such sale.

The bottom line is that the cases seemed to previously be shown to be "Active".  Judge TANENBAUM gave the plaintiff an opportunity to file certain completing paperwork by the deadline (December 9, 2010) and it APPEARS that when nothing was submitted, the Clerk then marked these cases "Disposed".  The consequences to the case and the property are UNCLEAR.  The possession of the property is UNCLEAR.

Adjourned Cases
It APPEARS as though some cases were simply adjourned to the next regular hearing date.  The ABSENCE of any indication that the requested affirmations were presented suggests that they might NOT have been, but that the plaintiff might have simply been given more time.

Fully Submitted Cases
I am INFERRING that "Fully Submitted" means that the plaintiff furnished the Court with the affirmations set forth in the orders, but this might be a misreading of the entry.

WITHDRAWN, But Active
The cases for which I have indicated "WITHDRAWN, But Active" are still showing as Active cases, though there is a docket entry indicating "Withdrawn".  I am INFERRING that this means that a particular motion or application for an order has been withdrawn, but that the case remains on the Court's active docket.

What appears to me to be happening, is where the defendant APPEARED and opposed a further adjournment, the Court may have REQUIRED the plaintiff to WITHDRAW a motion or application for an order, absent the required affirmation.  Where the defendant FAILED TO APPEAR, the Court may have continued the mater through an adjournment.  Most of the cases simply marked "Disposed" are likely to be cases where the foreclosure was mostly completed, but the files were not properly closed out, though another possibility is that there had been some intervening bankruptcy filing or other action that resulted in the case being essentially suspended.  One would expect that a civil stay would have been noted on the docket.

So my reading would be that the plaintiff might have come through with the required affirmation in three cases (those shown as "Fully Submitted"), might have failed to timely do so in five, with the motion or application for an order then being withdrawn, while in ten other cases the plaintiff may have failed to file the affirmation, but been given more time do to a default in the appearance of the defendant (further adjournments).

NOTE:  My PURPOSE within this thread is to show by reference to specific cases what is happening beneath the aggregates reported case statistics in New York State in consideration of the new attorney affirmation requirement.

The cases Mr. Roper posted were state cases in NY.  Only Federal cases are on Pacer.  I'm am not as familiar with Lexis but it appears only decisions are in Lexis.  The only way to get the pleadings from these cases unless someone has taken the time to post them on-line somewhere (doubtful) is to go to the County Court house.

The last motion for an extension of time, was written up properly, but I had no idea that an affidavit must accompany said motion, DUH, but I am getting wiser, but older.
