MORTGAGE FORECLOSURE SALE Default having been made in the payment of the indebtedness secured by that certain mortgage executed by and  husband and wife, to Ameriquest Mortgage Company, on the 9th day of July, 2004, said mortgage recorded in the Office of the Judge of Probate of County, Alabama, in Book 1956, Page 476, modified by Modification Agreement in Instrument 9321; said mortgage having subsequently been transferred and assigned to Deutsche Bank National Trust Company, as Trustee, of Ameriquest Mortgage Securities, Inc., Asset Backed Pass Through Certificates, Series 2004 under the Pooling and Servicing Agreement dated as of September 1, 2004, Without Recourse, by instrument recorded in, in the aforesaid Probate Office; the undersigned Deutsche Bank National Trust Company, as Trustee of Ameriquest Mortgage Securities, Inc., Asset Backed Pass through Certificates, Series 2004, under the Pooling and Servicing Agreement dated as of September 1, 2004, Without Recourse, as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Courthouse at  Alabama, on September 20, 2007, during the legal hours of sale, all of its right, title, and interest in and to the following described real estate, situated in  to-wit:Alabama.
