As expected, the First Circuit vindicated Ameriquest today in the Nosek case. 

The Bankruptcy Court's decision awarding the deadbeat debtor/borrower $750,000 was completely thrown out and judgment entered in favor of Ameriquest.

The First Circuit held that Section 1322(b) does not require lenders to apply payments in the same manner as a debtor is permitted to cure, absent specific language in the Chapter 13 plan requiring such a payment application methodology.
